It is based on EDI declaration of the manifest (Master Air Waybill and House Air Waybill) which is obliged by Customs and border Protection (CBP). It is the comprehensive bill to block the mass destructive weapons and have taken effect from Oct.2004.

The “Advance Electronics Cargo Information” law obliges AMS transmission of the manifest (M/AWB and H/AWB) 4hours before the flight lands at the first U.S. territory. If this requirement is not met, CBP can impose USD $5,000 as a penalty on the carriers, which is responsible for declaration, or forwarders. Or, CBP can reject customs clearance and flight landing if AMS data is nor received. (Each country is different about Penalty of omitted data)

Carrier and Importer or broker are in charge of sending Manifest. This information is automatically and electronically distributed to handling agents and airlines by TRAXON Korea.
Airlines are responsible for sending M/AWB (Included H/AWB if related items are consolidated shipment) and forwarders are responsible for sending AWB information (H/AWB) to airlines. If this requirement is not met, airlines or forwarders get penalty.
